Pennsylvania VerdictSearch’s Verdict of the Month

Pennsylvania VerdictSearch selected MBO’s defense verdict in Warnick v. UPMC Passavant as its “featured verdict” of the month, both online and in its print publication. This case was tried by Mike Feeney, an associate attorney with MBO.   The plaintiff in the case suffered a chainsaw injury to his leg and alleged that the emergency room physician negligently failed to diagnose a quadriceps tendon tear and failed to prescribe prophylactic antibiotics, which he claimed led to a severe knee infection.  The defense argued that prophylactic antibiotics were not indicated, that the quadriceps tendon tear was not detectible, and that the patient failed to follow discharge instructions relating to wound care.  The jury found unanimously for the defense.  The case summary is available online at: https://verdictsearch.com/verdict/verdict-for-hospital-in-suit-over-er-staffs-wound-care/
